The fight for control (ownership, eclusive use) of the common property att Point Vivian Park was initiated in the early 2000s by the Point Vivian Property Owners' Association with board members.

It was ostensibly concluded by the legal rulings in the two suits: Holliday Trust vs The PVPAinc board, and Pratt/Johnson vs PVPA, inc Board, clearly assigning ownership and exclusive use of the common property to the residential owners. The PVPA, Inc board from that time, April 2015, has continued their efforts to gain control of the common property through bylaw mismanagement, misinterpretation of legal doctrine and personal attacks on owners/members on successfully exercising their property rights
