Memo: To the Point Vivian Property Association Members/Owners - Part 2

Subject: The August 2, 2014 memo from the Point Vivian Property Assoc. Inc. Board of Directors to the PVPA membership at the annual meeting of the same date

Reference:

  1. The August 1, 2014 memo from Pratt/Johnson to the PVPA membership
  2. The August 1, 2014 e-mail from Keith B. Caughlin (Pratt/Johnson attorney) to Joseph Russell, cc. Teresa M. Bennett (PVPA, Inc. board attorney)
  3. The August 2, 2014 memo from the PVPA board to the membership

The August 2, 2014 memo from the PVPA board of directors to the attendees of the annual meeting (special meeting) of the same date is a complete distortion of the facts of the Pratt/Johnson legal action.

The referenced communications 1. and 2. clearly explain the Pratt/Johnson claim and its very limited impact on board operations. "Only the sale or conveyance of common property would require unanimous action."

The board communication 3. is a total fabrication, full of semi-truths half-truths and non-truth, apparently structured to win your approval to spend your money to enhance the board’s power…to sell or convey your property without your approval!

The truth is in the court's decision of April 2016. Absolutely no mention of any decision element concering any PVPA, Inc. board policy, practice or operating procedure, except the sale or conveyance of common property. The board lost. You won!! The South St. Extension was returned to you as common property...nothing else changed.

Attached is a copy of the board's memo wtih some annotation on some of the more ridiculous statements.
